UXA challenges the Organic Regulations approved by the PP in full (05/04/2013)

Violation of constitutional principles and our legal system have motivated UXA to challenge the "undemocratic" municipal organic regulation adopted by the PP majority in the month of March.

In ordinary full March 21, the PP alone approved Municipal Organic Regulation, after rejecting the PSOE-along-the nine amendments of addiction, two replacement and disposal, presented by Unity for Alguazas.

When independent spokesperson seems absurd that PP and PSOE unite to reject all amendments calling incorporate the rights recognized regulation laws, and all presented on a legal basis.

José Gabriel García called the mayor of authoritarian claim of UXA silence opposition by a regulation totally contrary to law.

The RO approved fully intended, among other things, limit six questions that can make the political groups in the city, prohibiting the use of mobile devices and audio and video recorders in full, limit the exposure time of five motions minutes speaking time of spokespersons.

UXA emphasizes that aims to curtail the work RO oversight and control of the governing bodies and ignores recognized rights such as access to public documents or operation of municipal groups.

The amendments also grant a requested words turn to neighbors based on Article 228.2 of the ROF, whose practice is never realized in full and the mayor always prevent the participation of residents.

The refusal of the PP, Bernabe Garcia called them "the mob bosses and intends to bring the interests of four petty politicians to other neighbors, so undemocratic".

Mayor also blamed the "wanting to turn the plenary sessions on his farm."

"Citizens of Alguazas not know what you do, because if there were transparency and they did, you would not ever govern" Bernabe Garcia concluded.

The two councilors UXA, José Gabriel and Juan Antonio, voted against the RO and now have filed an appeal to challenge the regulation.

Full record are prohibited and are limited to six questions from the opposition

Unit for Alguazas has decided to contest the RO in two articles, namely preventing any person the full public record and limiting to six questions that can make the opposition groups.

UXA has filed appeal before the session and, if action was dismissed, will be the administrative channels.

"We will not allow Alguazas have an illegal Organic Rules" Bernabe Garcia confesses.

Prevent record plenary sessions goes against the law, and so can be seen in Article 70 of the Basic Law and Article 88 of the ROF.

Also has settled jurisprudence in this regard, without going any further, the judgment 5838/2007, of the Division of Administrative Justice, which considers that "the limitation of cameras involves a kind of censorship to obtaining information, thereby depriving not only the media applicant of his fundamental right but also hindering the right to information of the neighbors. "

And also the Constitutional Court has ruled on the matter, as the judgments of 19 April 2004 and 20 June 2005, which nullify certain governmental agreements prohibiting access image pickup means.

And finally, has settled the judgment of the Superior Court of Justice of the Valencian Community of January 27, 2009, which recognizes the right of individuals to record with camcorder, without any authorization, the development of the plenary sessions municipal.

For questions limiting the opposition groups, UXA recognized that some constitutional provisions have been violated.

In full, Bernabe Garcia said that "our work will be impossible to audit and control the organs of government when government and eight councilors can only carry six questions".

Finally, the PP Barnabas warned that "if you expect to continue handling his job as a government dictatorship, will have strong opposition from UXA".

Independent spokesman accused the mayor of person undemocratic, and compared various actions endorsed by Benito Mussolini.

Meanwhile, "the mayor said that for him democracy is what the majority says, and if democracy is only the People's Party, who will have the majority."

The mayor's response was anger UXA councilors, who believe that the mayor is ruling for their constituents, and not for the rest of the villagers.
